CIRCULAR

 

Whereas chief executive officer of delhi state cooperative union Ltd. has informed vide letter No. DSU/2001/1851 dated 31-1-2001 that large number of cooperative society and also their managing committee members have approached the Delhi Cooperative Union Ltd. about making the contributions from the cooperative societies funds for the relief/rehabilitation of victims of Gujarat  Earthquake so that the Cooperative sector may also contribute towards mitigation of their sufferings,

 

Now keep in view the national interest at large, I , R.K.Srivastava , registrar Cooperative societies, Delhi exercising the power vested in me under section 47 of Delhi Coop. Societies Act,1972 read under rule 77 and 80(a) of Delhi Cooperative Societies rules,1973 hereby issuing the following guideline for the benefit of managing committee members of the Cooperative Societies and their members to unable them to make their contribution in this national cause.

 

  1. Societies which are in profit may in accordance with the provision of Sec. 47  of Delhi Cooperative societies Act,1972 read with rule  80(a) of Delhi Cooperative Societies rules,1973, can make contributions out of their net profits.
  2. Managing committees of Cooperative Societies can prescribe a minimum contribution per member for the members of  societies which would be debited to the accounts of the members and the total sum so collected would be sent through one cheque. For this members of the society shall have to be conveyed this decision of the managing committee in advance.

 

All the contribution shall be made in favour of  “Chief Minister’s Relief Fund”  through cheques/pay orders/bank drafts and should be deposited in the accounts section of the Registrar Coop. Societies, Delhi. It is also clarified that all the contribution in the Chief Minister’s Relief Fund will qualify for tax exemption  from Income tax under Sec. 80G of the Income Tax Act,1961.

 

             Since Gujarat Earthquake is a national calamity and relief/rehabilitation of its victims is a national cause, therefore, effort of the cooperative societies and their members should be mobilize maximum funds for this noble cause.

DIRECTIVE U/R 77 OF D.C.S RULES 1973

 

 

It has been observed that  many cooperative societies are indifferent towards getting their  audit conducted within the time limit prescribed  under Delhi cooperative Societies Act/Rule and registered bye-laws framed thereunder  and do not show transparency in their working by making audit report available to the members and also fail to convene Annual General Body Meetings as per the time limit prescribed u/s 29  of the Delhi Coop. Societies Act,1972.

 

In view of the order dated 03.10.1997 of the Hon’ble High Court in C.W.NO 4143/97 , the Societies are at liberty to get the statutory audit conducted by any qualified auditor to be appointed by the managing committee with the approval of Registrar Coop. Societies in view of his powers under section 53(1) of Delhi Coop. Society Act 1972 and submit the audit report within the prescribed time limit with the department. However, a panel of Chartered Account is being maintained for the convenience of all the societies and the societies may get the audit conducted by the Charted Account from the panel. All the Cooperative Societies are also directed to make audited accounts available to its members and have the same adopted in  Annual  General Meeting which should be called strictly as per time limit specified in Section 29 of  Delhi Cooperative Societies Act,1972.

 

         All the societies are directed to comply with the above said directive strictly. Any violation of the above direction will invite action against the Managing Committee under the         Delhi Cooperative Society Act/Rules.

 

This directive is in supercession of directive NO. AR/Audit(Pending)/99-2000/2070 dated October 24,2000.

Directive  UUDER RULE 77 OF Delhi Coop Societies  Rules 1973

 

It has been brought to the notice of the undersigned that inspite of issuing the directive under Rule 77 dated 14.12.99 which clearly states not to charge “Entrée Fee” in any form whatsoever, the Managing Committee are taking fee in the name of Development Fund, Transfer Fee, Common Good Fund or any other fee from the power of Attorney  holders.

 

    Therefore, I,  N.DIWAKAR, Registrar : Cooperative Societies in the exercise of power conferred upon me under rule 77 of Delhi Coop Societies  Rules, 1973  do hereby direct all the managing committee of Cooperative Group Housing/House Building Societies not to take entry fee  in the name of Development Fund, Transfer Fee, Common Good Fund or any other fee from the power of Attorney  holders. Violation of this directive will be viewed seriously and the managing committee of concern society will be held responsible jointly and individually. Action will be taken against such societies under the provision of the Act  and Rule for any violation of the directive.

 

This comes into force with immediate effect.

CIRCULAR

 

It has been noticed that the Cooperative banks and Thrift & Credit Societies are very liberal in Sanctioning the loans to their respective members without going into the following aspect:-

  1. Status of member.
  2. Repaying capacity.
  3. Without monitoring the non-payment by the loanee
  4. Sanction of loan to woman member without obtaining queries from the competent members.

 

Beside above, while filling the cases for execution, latest addresses of the member are not verified and simultaneously provided. These cases are generally filed after a considerable time after the default in the prescribed monthly installments. It is needless to remind here that cases u/s 60 should be filled immediately after three consequent default payment of loan amount. In this way, banking institute not only put burden on the recovery branch but also increase there N.P.A which is necessary for health banking systems. In the absence of proper and latest addresses of the Judgement Debtors, a number of cases are lying  pending in the branch of recovery. It is also been notices that these institutions have never provided latest addresses inspite of the knowledge of such cases.

 

             To avoid these discrepancies, it has been decided to impresses upon these institutions to be remained vigilant and careful while sanctioning the loan to the member and proper safe guards should be adopted to avoid losses to the institutions. To expedite the pending cases, all the degree holders are once again advised to provide latest addresses of the Judgement  Debtors to the recovery branch failing which ii will be presumed that the Decree holder are not interested for finalization  of there cases which will be kept in  abeyance in future and responsibilities will be fixed against the default Decree Holder. These institution are further directed to :-

 

a)      Keep a tab on the movement of the loanee who frequently changes their residential addresses.

b)      File cases u/r 60 immediately after the three default of payment loan.

c)      Provide latest addresses while filling the cases for execution u/r 60 of DCS Act,1972.

d)      Banking  & Arbitration Branches are being advised to expedite the pending cases.

Since, these instruction are in best interest of the banking institutions, therefore, will come into force with immediate effect.

AUDIT FEE NORMS IN RESPECT OF URBAN COOP. THRIFT & CREDIT SOCIETIES AND BANKS

 

For first 5 lakhs of working capital                                                            Rs. 4.00 per 1000

For first 10 lakhs of working capital                                                          Rs. 3.00 per 1000

For first 15 lakhs of working capital                                                          Rs. 2.00 per 1000

For first 20 lakhs of working capital                                                          Rs. 1.00 per 1000

For first 50 lakhs of working capital and above                                      Rs. 0.50 per 1000

AUDIT FEE NORMS IN RESPECT OF OTHER SOCIETIES SUCH AS HOUSING, INDUSTRIAL, CREDIT AND NON-CREDIT SOCIETIES ETC,

 

For first 5 lakhs of turnover                                                                        Rs. 3.00 per 1000

For first 10 lakhs of turnover                                                                      Rs. 2.00 per 1000

For first 15 lakhs of turnover                                                                      Rs. 1.00 per 1000

For first 20 lakhs of turnover  & above                                                    Rs. 0.50 per 1000

 

This minimum Audit fee shall be Rs. 2,250 /- and the maximum Rs. 1 lakh  for Coop. Banks, Delhi Coop. Housing Finance Corporation Ltd. and Delhi Consumer  Coop. Wholesale Stores ltd. and Rs. 70,000 /-  on all types of Primary Coop. Societies.  Besides this ;

 

           i.             No separate fee will be given for branches.

         ii.             33% of total Audit fee  shall also be paid in those cases where Concurrent Audit is allotted and conducted  by the Auditors.

       iii.             Further 25% of the total Audit fee will be paid in those cases where tax Audit is involved subjected to a minimum of Rs. 3,500 /- and maximum Rs. 10,000.

 

EXPLANATION:

 

Turnover: it means the total receipts or total disbursement of the year whichever is higher after excluding the deposits, withdrawals from banks and also opening and closing cash in hands.

 

Working Capital: it includes such portion of Reserve Funds and other Reserves apportioned out of the profit, paid-up the share capital, loan and deposits received and debentures issued by a Cooperative Society as have not been locked up in building and other fixed assets.

 

This supercedes all previous order on subject. The above scales of Audit fee are applicable with immediate effect and will be paid by the concerned Society on approval from this office.

ARE YOU AWARE THAT ‘AGREEMENT TO SALE’ IS NOW

RREQUIRED TO BE REGISTERED

 

 

It is brought to the notice of the general public that the Government of India vide a Gazette Notification No,56 dated 24th September,2001 published in the Gazette of India, Extraordinary, Part-II, Section-1, has Effected – following amendments :

 

  1. Amendment of Section 53(A) of transfer of Property Act, deleting words to ‘the contract through required to be registered has not been registered’.

 

  1. Introduction of section 17(1) (A) in the Indian Registration Act  making contracts to transfer for consideration of any immovable property in the nature of section  53 (A) of the Transfer of Property Act including agreement to sell compulsorily registerable.

 

 

  1. Addition of new article namely article 23(A) of India Stamp Act 1899. ‘ conveyance in the nature of part performance chargeable to 90% of the duly payable as a  conveyance’.

 

 

With the introduction of these amendments, the document contained contracts to transfer for consideration, any immovable property including agreement to sell for the purpose of Section 53A of the Transfer of Property Act,1882, are required to be registered if they have been executed on or after 24th September,2001.

 

The stamp duty to the extent of 90% of the duty as a conveyance payable on the consideration set forth in the document shall be payable on such instrument and the rest of the 10%  of the duty shall be payable at the time of completion of document.

 

 

It would be in the interest of executants to secure their rights of the properties, by registering such documents. Non-registration of  such instruments may render these documents inadmissible in evidence in any office or court for filling any suit or claim. We request the executants of such instruments to refer to the notification No. 56 dated 24th September for further clarification.

DIRECTIVE UNDER RULE 77 OF THE DCS RULE, 1973

 

It has been noticed that some societies take very long time in making a reference to the Registrar for initiating the expulsion proceeding against the defaulters members after passing such resolution u/r 36 (1) of the DCS Rule, 1973. this results into avoidable delays and in the long run affects the interest of the society. Sometimes, the proposals are submitted years after passing such resolutions.

 

In view of the above , I , N.DIWAKAR, Registrar Cooperative Societies, in exercise of the powers vested in me u/r 77, do hereby direct that the proposal of such explusions,  after passing of the resolution in accordance with  Rule 36 (1) by the Managing committee of the society be brought to the notice of Registrar cooperative Societies within a period of two months positively for further consideration  of such proposal as per provision of Act & Rules.

 

                             This Directive will come into force will immediate effect.

FOR GROUP HOUSING SOCIETIES

 

The MCD has announced the extra rebate of 15% in addition to 20% rebate on timely payment w.e.f 2000-01 to the individual prop./flat owners of group housing societies / Apartments, who are maintaining their internal service themselves, provided that the flat/ properly is self occupied by original allottee.

 

It has been noticed that the flats/property owner which has sold or let out their property, are also claiming the extra rebate of 15% while they are not entitled for the same. It is advised to the tax payer, who is claiming the 15% extra rebate, should produce and undertaking  declaring therein that he is the original allottee of flat/prop. And the property has neither been sold nor let out anyone and in case his decleration found incorrect , the additional rebate of 155 shall automatically be withdrawn. The prescribed proforma  of decleration can be obtained from the office of Keshav Puram. Please note that while making the payment of property tax the claim of 15%  extra rebate will not be entertained without producing such declaration .

 

                 It is further clarified that the additional rebate of 15% will be given on the amount after deduction of 20% rebate of timely payment e.g. if the bill amount is Rs.1000 /- after allowing 20%  rebate it comes to be Rs.800 /-. The 15% rebate will be given on Rs.800 /- not on Rs. 1000 /-. Hence in this way the net rebate works out to be 32% not 52%.

 

FOR EX-SERVICEMAN

 

In case of ex-serviceman MCD has announced a special rebate of 20% w.e.f. 2000-01 subject to a maximum limit of Rs.1000. in this case also the special rebate of 20% will be allowed on the amount arriving after deduction of 20% rebate of timely  payment. In this way the net rebate worked out to 36% and not 40%.

 

The assessee  of this category, while claimimg the special rebate of 20% should submit the sufficient proof of their identity as ex-serviceman as well as an undertaking declaring therein that he has not been availing the benefit of special rebate on any property in Delhi and the property is self occupied.

As per provision of Rule 111(6) of the Delhi Cooperative Societies Rules 1973, the Recovery Officer  is charging the 55 execution fee on  all  sums recovered from the judgement debtor which is being credited to the aforesaid fund and the same is being deducted from the account of the bank as well as other financial institution from the Decree Holder and not from the Judgement Debtor as prescribed in Rules.

In future, as pre provision of the Rule 114 under the title cost of execution the Recovery Officer Executing the Award may recover in addition to the Decrital Amount from the Judgement Debtor the cost of execution as arrear as the cost of land revenue and pay such amount to decree holder. It has also come to the notice that the banking institution already charging the 5% cost of decrital amount from the judgement debtor. As the Recovery Officer has been directed to recover the amount of execution charges from the judgement debtors,  no banking institution will charge such 5% fee from the judgement debtors in any case.

This directive will be effective from the financial year 2002-03.
